These Terms and Conditions (the "Terms") govern your engagement with Immanuel Electrical Services LLC ("we," "us," or "our") for electrical services (the "Services"). By entering into a service contract with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must refrain from utilizing our Services.
1. Acceptance of Terms
By requesting or utilizing our Services, you represent and warrant that you are at least [18] years of age and possess the legal capacity to enter into a binding agreement. If you are acting on behalf of a business or entity, you further represent that you have the requisite authority to bind such entity to these Terms.
2. Scope of Services
We provide a comprehensive range of electrical services, which may include, but are not limited to, the installation, maintenance, and repair of electrical systems. A detailed description of the Services to be provided shall be set forth in individual service contracts, which shall be deemed to incorporate these Terms by reference.
3. Non-Refundable Deposits
All deposits made for Services rendered by Immanuel Electrical Services LLC are strictly non-refundable. By executing a deposit, you hereby acknowledge and agree that you shall have no entitlement to a refund of any kind under any circumstances.
4. Service Contracts
Service contracts executed between you and us shall delineate the specific terms, conditions, and pricing applicable to the Services to be performed. By signing a service contract, you agree to be bound by the terms contained therein, which are incorporated herein by reference.
5. Payment Terms
Payments for Services rendered are due upon completion of the work, unless otherwise specified in the applicable service contract. We reserve the right to impose interest on any overdue amounts at the maximum rate permissible under applicable law.
6. Scheduling and Cancellations
All appointments for the provision of Services are subject to availability. Should you need to cancel or reschedule an appointment, you must provide at least [24/48 hours] notice. Failure to comply with this notice requirement may result in the imposition of a cancellation fee.
7. Client Responsibilities
You shall ensure that access to the work site is provided and that all requisite permits are secured prior to the initiation of Services. You are solely responsible for maintaining a safe working environment in compliance with applicable health and safety regulations.
8. Limitation of Liability
To the fullest extent permitted by law, Immanuel Electrical Services LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your utilization of our Services, even if we have been advised of the possibility of such damages. Our aggregate liability for any claims arising from or related to these Terms shall not exceed the total amount paid by you for the Services in question.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws and regulations of the Authority Having Jurisdiction (AHJ) over the Services. You agree to submit to the exclusive jurisdiction of the appropriate authorities for the resolution of any disputes arising under these Terms.
10. Indemnification
You agree to indemnify, defend, and hold harmless Immanuel Electrical Services LLC , its affiliates, officers, directors, employees, and agents from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of our Services or any breach of these Terms.
11. Amendments to Terms
We reserve the right to amend or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued utilization of our Services following any amendments constitutes your acceptance of the revised Terms.
